He could be Allegemeine SS, I think.
Not sure if that's the Totenkopf SS capbadge he's wearing or not-I'm not really that well up on Nazi insignia.

Not likely. First, the eagle is a Wehrmacht style one (note how its wings are widest at the top not the middle like the SS version). Second, he has a enlisted Heer style belt buckle on.
Also, in any case, he is wearing an enlisted peaked cap (note the leather chin strap) not an officer's one (silver double cord chin strap) so he is definitely not an officer.

I thought the eagle was unclear, appears SS on one wing & heer on the other.
He has a '38' on the collar tab, 38th heer regiment are infantry which doesn't seem to fit with the totenkopf.
38th 'Nibelung' division have a winged helmet badge & were grenadiers.
If it's a '36' rather than a 38 the 36th Panzer regiment could fit.
His rank tab seems to indicate an SS Scharfuhrer.
If, If, If.... sorry for rambling.
One of the 'civil' arms of the party or SS still seems quite likely to me.
I've enjoyed trawling through a stack of books, so cheers for that, but nothing definite's come to light, someone's bound to come along who really knows though.

I would like to do a bit more digging.
The picture appears to be of a moderately well-to-do German family group, though the actual relation of the adults can not be determined with ceritude. They are standing in the cold of a winter day in daylight. The presence of fresh snow on the trees tells us it is not a strickly urban scene, but rather a suburban or park setting. The temperature is probably a few degrees below freezing, due to the lack of hoarfrost on their persons.
The condition of their clothing and footgear suggests this picture was taken well before the beginning of WWII. The civilians appear all to have fur collars, except for the woman between the men seems to be wearing "persian lamb" coat.
The civilian man appears to possibly be a Nazi party member due to the round collar pin which may be a party-member badge. He appears to be holding a second camera (not the one taking this picture).
The presence of the carraige implies an infant child. That a child in not seen suggests a small child swaddled and protected from the cold. The woman with her hands on the carraige implies that she belongs with the pram, impling she is a mother. It is likely that the soldier and she are married and young parents. This is further implied by their being the center of the photo, that the reason for the photo being some commemoration of the group being gathered.

From right to left, of the five adults:
Father,
Mother,
Son,
Bride & Mother
Daughter to Elders & sister to the soldier.
Of course, that is only an educated guess.

Enlisted Allgemeine SS assigned to the 38th Abteilung of which ever region he was assigned to. In the early thirties, the Allgemeine SS did not have the SS runes but rather the numbered detachment they were assigned to. This later changed to SS runes and the numbered detachment was moved to the shoulder boards.

he is def ss...pic mostly likey taken late 35 onwards as cap eagle this size only appeared then...def 38th also
i'd say all are siblings with the exception of ss man...just for the craic..K

i'd say it a babies christening day...also i think now that the guy on the left is the odd one out ..poss the babies father as he all the others seem to look like members of the same family...i'd say pic taken in church grounds..camera box could be box of camera being used!?
