The culture of political discussion in the United States is really at an all time low. Both political factions seem to have resorted on throwing dirt at each other.:(

It's nice to know both of you non-citizens of the USA are still very interested in the legalities of our Constitution. Thanks for your non-useful comments.

The question isn't whether he won; the question is, was he legally entitled to run?

The distinction should be obvious even to you. And we are entitled to a definitive answer to that question.

I see the distinction, I also wee a lot of people struggling to deal with the massive case of sour grapes they had delivered.

Tex, I find the legalities of your constitution fascinating, I also find the pathetic mud-slinging/smear campaign that has gone on since he won quite entertaining.

Please, explain again why you aren't happy with the birth certificate that was published?

    Stefan,

What the WH has released is a Certificate of Live Birth (a short form); that is, the State of Hawaii is guaranteeing that BHO was born alive somewhere and his birth registered with the state of HI. That does not mean he was born in Hawaii. Only an original long form Birth Certificate will indicate the actual place of birth.

The issue is: a candidate for the office of president must be natural born citizen in the US proper or its territories to an American citizen (father or mother or both). (There are other issues too like how old the American citizen (the mother in this case) was at the birth and how long had she resided in the US. Mrs Obama's status is also at issue because of her extensive foreign travel and absence from America or its territories at an earlier age.)

A short form certificate of live birth is not convincing to many Constitutional lawyers; apparently there is a BHO long form Birth Certificate, but BHO chooses NOT to release it. In fact he has many lawyers trying to prevent it from ever seeing the light of day. If he would release the long form, this issue would go away.

The question is: why not release the proper long form and end the issue.

(Even his paternal grandmother has sworn twice she was present at BHO's birth in Kenya. )

And if BHO is NOT a citizen then, his presidency is invalid and null. All laws signed by him would not be valid either. And a Constitutional crisis would erupt akin to that of when the southern states voted to secede from the union and led to the War of Northern Agression (my slight bias regarding the civil war). The states are not prohibited from secession in the Constitution, but Union forces prevailed and the union was "preserved" going against the Constitution.

By an large it is an issue of "rule of law" (follow the Constitution) or make up rules as you go along.

I'm afraid that even IF BHO was found to NOT be a citizen of the US nothing would happen. Then what's the point of the Constitution and/or laws anyway?

Some congressional critters are trying to require adequate documentation for proving citizenship before the oath of office is ever administred, but with a Demorate party dominating the Congress, such a bill has as much chance as that proberbial snowball in Hades.

    Or a snowball in Hawaii?

Perhaps it is locked away in the safe where the Bush National Guard records are kept?

Back when Goldwater ran it wasn't clear if the territories counted. I think that's when the decision was made that they did. (He was born in Arizona territory before it was a state as I recall)
It's pretty clear he is citizen. If you are born to US parents then you can claim US citizenship. (My father was born in Candada but his parents were US citiizens). However if he wasn't born in the US he doesn't meet the constitutional requirements for the office. (They were talking about changeing the requirements recently when both Democrat and Republican goveners looked like good potential candidates talk has quieted since Michigan and California ran into some problems.

You see this is what I don't get, you have a birth certificate saying he was born in Hawaii, or at least that his birth was registered there the same day that he was born. Now, if you are suggesting that he was born elsewhere that means that his parents must have got back from wherever he was born to Hawaii to register the birth.

It is also interesting that the comments by his grandmother (which people keep bringing up) disagree with the claims of most of the lawyers who are questioning his citizenship.

Frankly it just sounds like a lot of pucilanimous whining, sour grapes and other cliches.

I see your fast to come to Obamalama-ding-dongs rescue but you conviently "forgot" that the other party did the EXACT SAME THING to Bush Jr for eight years and THEY never gave Bush a chance or the benefit of the doubt.

Awe come on Carl, you know that Bush's opponents in both of his election were far and away more intelligent than Bush could have ever been. They never fumbled over words like Bush, that old dimwitted flake. Heck, they never confused the Russian Prime Minister for the Russian President like...wait...that wasn't Bush that misspoke, it was our present President, just this week.

The point I am trying to make is that while the press and Democrat party rode GWB hard all the time about his elocution, acting as though it was it was an indicator of the lack of intelligence, they seem to gloss over our current presidential interation's liguistic mistakes as though the stumbled-upon words are now indicators of a higher level of intelligence. He has so many higher thoughts in his head at the same time, he can't speak of them all at once. Once again we see that the Southern accent is perceived as the voice of the ignorant, just because it "sounds" like that.

Who's the ignorant one, the person who uses one of the many "Southern" accents, or the one who draws false conclusions about a person's intelligence based on how that person chooses to speak?

A good many of you have spoken with me on the telephone and some have made friendly comments about my drawl, which I must admit, I do have, but tend to slather it on a bit thicker when talking to people who "aint frum 'round cheer." I can't assume what their thoughts of me are based on the is new bit of knowlege concerning me, but do hope that unfavorable considerations of me are not generated by my drawn out speach pattern and use of regional colloquialisms. It is who I am.

Wow, I have dragged this thread out into left field.

I don't know Carl, I distinctly remember people on this very site going on about how it was practically treason to criticise the president when soldiers were fighting a war etc and yet those same people don't seem so willing to give Obama the same benefit of the doubt.

As for Bush and his accent Jeff, I'm not sure people took that as a sign of a lack of intelligence as such though maybe his Texan cowboy image didn't quite match up with the image of sophistication people expected from a US president (though quite where this sophisticated image came from whilst Clinton was in office I'm not entirely sure). What people made fun of was GWB's apparent total inability to speak without saying something totally stupid, it made him look massively out of his depth and quite frankly incapable.

Now obviously everyone makes verbal gaffs, there was a program of US presidential outtakes on the BBC a while ago which included errors by all of the presidents and electoral candidates of the last 30 years or so. The issue is that it seemed like every time Bush opened his mouth he said something stupid, he didn't just fumble over words or make simple errors but managed to talk utter nonsense for extended periods of time. IMHO this doesn't necessarily mark him as an idiot, I just think he was particularly bad at giving speeches that had been written by others. If you want evidence of this look at the totally impromptu firetruck speech from shortly after 9/11, unplanned, unrehearsed, he just got up there and did it, somehow it worked.

So to sum up an unnecessarily long post, it is hillarious to hear the folks who were staunchly against any attack on the president slamming Obama, Bush wasn't an idiot, he was however a pretty terrible public speaker and southern accents are great though sounding like a cowboy whilst talking from the oval office may not be ideal.
